Terms

These terms apply to every design, build and care plan agreed with Aubergine Jardines S.L. Anything specific to your garden is written into your quote, and the quote takes priority over these terms.

First visit and quotes

The first visit is free and carries no obligation. It ends with a rough price range, not a quote.

A design is quoted as a fixed fee, by size. A build is quoted line by line once the design is approved, and the price is fixed for 60 days. If we find something underground that changes the work, such as rock, old foundations or services, we stop, explain and price it before we continue.

Payments

For a build, a third is due when the design is approved, a third when the hard landscaping is finished, and the rest at handover. Invoices are due within 14 days. Care plans are billed monthly in advance.

The design

The drawings are yours once the design fee is paid. You may build them with us, with another company or yourself. We may show the design and photographs of the finished garden in our own work, without the address.

On site

You give us safe access to the garden on the agreed days, and water and power where we need them. We keep the site tidy, clean up every evening and take away what we remove. Anything worth keeping, such as stone, trees and good soil, stays unless you ask otherwise.

The plant guarantee

Every plant we supply and plant is replaced free if it fails within two years, as long as the irrigation we installed stays on and set as we left it. On a care plan, the guarantee lasts as long as the plan. It does not cover damage from frost below −3 °C, storms, animals or work by others.

Walls, steps and paving we build are guaranteed for ten years, and irrigation and lighting for two, against faults in materials or workmanship.

Care plans

Care plans run month to month, with no minimum term, and can be stopped by either side with thirty days’ notice. Larger jobs, such as tree work or new beds, are quoted separately.

Changes and cancellation

You can cancel a build before work starts, paying only for design work already done. Once work has started, we invoice what has been built and the materials ordered for your garden.

Liability

We are insured for public liability up to €1,500,000. We are responsible for damage we cause, but not for losses we could not reasonably foresee.

Law

These terms are governed by Spanish law. Any dispute goes to the courts of Valencia, without affecting your rights as a consumer.
